For many people, pets become cherished family members who bring joy and companionship to their lives. You feed them, care for them and love them unconditionally. And yet few pet owners consider what might happen to their beloved fur babies if something unexpected happens.

The legal reality of pet ownership in Florida

Despite the deep bonds you form with your pet, Florida law views animals as personal property. It’s similar to how the law considers furniture or vehicles as assets.

Thanks to this classification, your pets don’t automatically receive the same considerations as human family members in your estate plan. Without specific instructions, your furry companions could face uncertain futures when you’re no longer here to care for them.

Legal options to protect your pets

Florida offers several ways to ensure your pets receive proper care after you’re gone:

  • Pet provisions in a will: Designate both a caretaker and funds for your pet’s care
  • Florida pet trusts: Create a special trust to ensure legally enforceable arrangements with specific instructions for caregivers and fund allocation
  • Durable power of attorney: Plan temporary care arrangements and funds in case you get hospitalized or incapacitated

Each option provides different levels of protection and control over your pet’s future care.

When no plan exists for your pets

Without specific instructions, your pets face uncertain outcomes. They might go to family members who may not want them or know how to care for them properly.

In worst-case scenarios, your pet can end up in shelters where animals may face adoption challenges or even euthanasia. Your beloved furry companion might not receive the same level of care and love they enjoyed with you.
