How can you avoid probate delays in Florida?

On Behalf of Erin Kirkwood Law, PLLC | Oct 17, 2025 | Probate |

When someone dies, their family must handle their money and property through a legal process called probate. In Florida, this process can take months or even longer without a solid plan. Taking simple steps now can make things much easier for your loved ones later.

What is probate and why is it slow?

Probate is the court process that manages a person’s property after they die. A judge ensures that the individual pays their bills and distributes their property to the rightful owners. In Florida, it can move slowly when papers go missing, the will isn’t clear, or family members disagree about what should happen.

How can you speed up probate?

Planning ahead can make probate much faster. A few simple steps now can save your family time, money and stress.

  • Make a clear, updated will. Sign it with witnesses as Florida law requires.
  • Use a living trust. Move your property, such as your house or bank accounts, into the trust so it skips probate completely.
  • Name beneficiaries. Add beneficiaries to your bank, life insurance and retirement accounts to transfer funds directly.
  • Keep papers organized. Store bank statements, deeds and account details in one safe place so your family can find them easily.

Even small steps like these can prevent long court delays and protect your family from added stress.

If you’re unsure how to start, talk to a Florida estate planning lawyer. They can explain your options and make sure your paperwork meets state laws. Getting help early gives you peace of mind that everything is done right.

Why is it worth it to plan ahead?

Planning ahead saves time and protects your family from confusion. With a good plan in place, your loved ones can settle everything smoothly and focus on each other instead of court problems.
